The Failure of the 28-Article Peace Proposal for Ukraine: Why Diplomatic Efforts Continue to Stumble

Europe breathed a deep collective sigh of relief on Monday, as the crisis caused by the presentation of a new 28-article proposal for achieving ceasefire appeared – briefly – to have been contained. A Washington representative spoke of "notable headway" after Ukraine-US talks in Geneva. On Monday night, the Kremlin made its response: another massive barrage of rocket attacks on Kyiv.

The Rhythm of Diplomacy and Destruction

The succession of conflicting incidents captured the bleak nature of the recent timeframe. By day, negotiation efforts are fought: positive announcements are released from various governments. Significant resources is devoted on containing particular approaches. By night, the Kremlin forcefully demonstrates the world that, for them, war remains the main instrument for achieving "resolution".

After-Dark Attacks

As the offensive unfolded into the early hours of Tuesday, the present situation of Ukraine's defenselessness was exposed. Ukraine is capable of detecting projectile deployments from Russian territory, a capability afforded by timely intelligence. From witness perspectives, defense planes that had been dispatched to engage hostile cruise missiles flew past – sophisticated military planes supplied to Ukraine by Western partners.

Moments later, Kyiv's anti-aircraft weapons engaged: several firings fired to intercept a incoming threat. This was a modern interception technology at work, presumably delivered by allied countries. Every firing jolts you unexpectedly, shaking the windows. The instant of fear quickly becomes resigned acknowledgment: maybe the incoming missile won't cause damage this time, protecting urban areas from devastation and another blackout.

Continuous Dangers

Not long after, a heavy machine gun engaged a aerial vehicle somewhere nearby, part of a defensive team – probably Western-made equipment. Regrettably, the shots failed to hit the hostile drone – it maintained course toward its destination.

With pauses, this continued until dawn. Kyiv awoke to the early updates: several casualties, devastation and infrastructure problems in multiple buildings as a result of the nocturnal offensive. As customarily, everyone still maintained normal activities – enduring hostilities. But those full day encapsulated Ukraine's essential dependence on international aid – a dependence that regional partners are evidently unprepared to replace in the immediate future.

Ineffective Peace Efforts

The detailed framework from American leadership sparked intense emotion, controversy and deep concern – and briefly redirected concern from Ukraine's largest corruption scandal in years. Yet, we have witnessed similar scenarios, after prior negotiation attempts and bilateral conferences.

Every new proposal from US leadership adheres to the consistent cycle: a negotiation push against Ukraine, which Kyiv, with allied governments, succeeds in resisting. They contain the crisis but never actually win the battle. This trend will, certainly, continue.

Political Considerations

It is tempting to accuse specific actors of consistently pushing Kremlin's demands. But that does not seem to be the entire situation. US administration works based on a premise familiar among seasoned negotiators: you cannot secure via talks what you have failed to defend militarily. The White House assumes that it is unrealistic to force Russia to surrender the land that it currently occupies in Ukraine's southern or eastern regions.

The challenge is that while acknowledging this situation, American administration does little to deter Moscow, through words or deeds, from thinking that the status quo will not evolve additionally in its favour in the near future.

Opposing Positions

Therefore, Moscow is certain that duration works to their advantage – that Ukraine and its allies are coming close to fatigue. Their motivation to accept conditions that does not give them the largest achievable advantage is almost completely absent. There may be many attempts to end hostilities, but they will persist as long as Russia's leadership remains completely certain in the result.

On the contrary, Ukrainian leadership believes that Ukraine can still persist, slowly losing lives and land but avoiding a total frontline collapse until circumstances change in its favour.

Current Realities

Realistically, there are no actual prerequisites for a truce. Now, subjective factors are entering the equation: political desires to broker a ceasefire and achieve global acclaim, and the government's double obstacles – on one hand, not to alienate a key ally, and on the other, to unite the population around the national cause against any proposal Kyiv finds unworkable, so that their focus does not switch to internal issues. And although their task will now be considerably more difficult after recent developments, it remains very improbable that this will alter their fundamental strategy.

These conflicting dynamics are influencing discussions.

Assessment and Future

It took a only one week to eliminate the suggested clauses of the most recent proposal. Assertive and inconsistent approach of the matter by American leadership, resistance by Ukraine and the rest of Europe, along with calming attempts of diplomats, and finally, recent disclosures, all achieved their purpose.

While new initiatives based on previous concepts are imminent, Kyiv, London and other Western governments should arrive at a critical understanding: Ukraine and Europe will only be able to counter negotiation assaults from Washington that are based on Russian demands and demonstrate certain reluctance to change the course of events, if they remain united and strengthen their defence capabilities at a significantly accelerated rate. If they do, neither political nor armed coercion will be able to overcome them. In the meantime, Ukraine's ability to defend against evening bombardments will, for the coming months, primarily depend on continued Western support.
